November 2019 Pro Bono Briefing and Training: VAWA Nuts and Bolts, plus Late Breaking Updates

Tahirih Litigation Counsel Richard Caldarone and Director of Legal and Social Services Kursten Phelps review litigation updates, proposed rules related to USCIS fees, fee waivers, and asylum applicant work authorization applications, and an interim final rule implementing “safe third country” agreements for asylum seekers. At the 36:36 mark, Kursten Phelps reviews practical, introductory information on the nuts and bolts of filing a VAWA self-petition for immigrant survivors who are abused by their U.S. citizen or Lawful Permanent Resident spouses.

Update: After this webinar was recorded, the Federal District Court for the Northern District of California in Seattle v. DHS enjoined DHS from requiring use of the 10/24/19 edition of Form I-912, Request for Fee Waiver. That edition has been removed from the USCIS forms website.  USCIS has reverted to requiring the 03/13/18 edition of Form I-912 until further notice.  USCIS will also accept prior editions or a written request.   Please consult with your Tahirih mentor attorney for advice on which version of the I-912 form you should use in your case.
